Our General Terms and Conditions of Sale define the terms and conditions applicable to sales concluded between persons wishing to make a purchase via the website http://www.louischevrolet.ch (hereinafter referred to as "the Customer") and Louis Chevrolet Watch Company "(hereinafter referred to as LCWC), a company located En Roche de Mars 10, CH -2900 Porrentruy, Switzerland .
The Customer and Louis Chevrolet Watch Company SA are hereinafter referred to as "the Parties".
These conditions apply exclusively to non-commercial physical persons.
The acquisition of a property by this site implies an unreserved acceptance of the General Sales Terms.
Article 1: Order
1.1 Parcels are dispatched worldwide.
1.2 The order established by the customer consists of products forming part of the online catalog established by LCWC.
1.3 The order can only be registered on the site if the user has clearly identified himself. To do so, the Customer is invited to identify himself by giving his name, his first name, a valid e-mail address, his postal address and his telephone number. LCWC reserves the right to cancel a sales order which would present in his view, any form of risk.
1.4 All orders constitute acceptance of prices and description of products available for sale.
1.5 Orders are payable only in Swiss Francs (CHF) for Switzerland & Lichtenstein (All TAxes Included), and in Swiss Francs (CHF) for the rest of the world (Excluding Taxes).
1.6 LCWC is committed to honoring orders received within the limit of available inventory of products.
1.7 Gift vouchers are not taken back or exchanged
Article 2: Validation
2.1 By validating his order on www.louischevrolet.ch , the Customer acknowledges having previously read and accepted without reserve the present General Conditions of Sale on the date of its order.
2.2 Unless proved otherwise, the data recorded by the seller shall constitute proof of all transactions.
Article 3: Availability
3.1 The offers of products are valid as long as they are visible on the site, within the limit of available stocks.
3.2 In the event of an unavailability of a product after the order has been placed on the Customer, LCWC will inform the Customer by e-mail as soon as possible. The customer's order will be modified or canceled if he wishes so, and a full refund will be made to the Customer's account.
3.3 The availability information provided at the time of the order is given only as an indication. The products are reserved only after payment of the order.
Article 4: Delivery
4.1 Gift vouchers are exempt from delivery. Gift vouchers are sent by mail.
4.2 LCWC undertakes to comply with a preparation and delivery period up to maximum 5 days (subject to a positive evaluation of payment by PayPal or on the bank account). This period might be slighly longer during the watchmaking holidays (from mid december until mid january and between mid july until mid august)In the event of a delay in delivery, LCWC will inform the Customer by email.
4.3 In the case of items deliverable on different dates due to their availability, the delivery time is based on the longest delivery period. However, LCWC reserves the right to split deliveries. Participation in the processing and shipping costs will be invoiced only for one shipment. LCWC cannot be held responsible for the consequences due to delayed routing. In case of delay, an email will be sent to the Customer.
4.4 In the event of a delay of more than 7 days in relation to the planned delivery date, the Customer may terminate the contract of sale and be refunded.
4.5 Upon delivery of the order, the Customer shall verify its contents In the event of apparent non-compliance, the Customer shall notify it by e-mail to email@example.com in the shortest time possible.
4.6 When the delivery agent presents a deteriorated package, the Customer has the right to refuse it.
Article 5: Sale price, method of payment
5.1 Prices are quoted in Swiss francs (All Taxes Included) for Switzerland and Lichtenstein, and Swiss Francs (Excluding Taxes) for the rest of the world. Any price in other currency is given only as an information.
5.2 LCWC reserves the right to change the price of the items at any time.
5.3 Items and any charges will be invoiced on the basis of the rates in effect at the time of registration of the order.
5.4 Products remain the property of LCWC until full payment is received.
5.5 Online payment is done by credit transfer, bank deposit, or Paypal.
5.6 LCWC makes every effort to ensure the confidentiality and security of data transmitted over the Internet. All data exchanged on the web are encrypted. Payment is fully secured.
Article 6: Satisfied or refunded
6.1 In the event of a model or article error during the preparation of the order, LCWC agrees to exchange the item. LCWC will be responsible for the costs of return and reshipment.
6.2 The Customer has a legal withdrawal period of 14 days from the date of receipt of the items. Return expenses incurred by the client are non-refundable.
Upon receipt of the package, LCWC will judge the perfect condition of the items. No return will be accepted if the returned products have been visibly worn, damaged, or their packaging damaged or deteriorated, making the product unsuitable for resale. If the return is refused by LCWC, the items will be returned to the Customer at the expense of LCWC without the Client being able to ask a refund or any compensation.
6.3 In the event LCWC makes a product refund, it will be made by credit to the Client's bank account. LCWC may, however, postpone the refund until the goods are recovered. LCWC agrees to reimburse all amounts paid in connection with the order, including delivery charges if invoiced. The return fees are to be paid by the Customer.
6.4 Gift vouchers are not exchanged nor refundable
Article 7: Warranty (Link to the warranty conditions page)
7.1 LCWC is committed to repairing or replacing any item with hidden defects or quality problems during normal use of the product under the 2-Year Legal Warranty and Manufacturer's Warranty (2 Years minimum). For an optimal treatment, all requests for return must be announced to the LCWC customer service by e-mail at the following address: firstname.lastname@example.org .
The return costs are the responsibility of the Customer beyond the 14 days following receipt of the order. LCWC is responsible for the costs of redirection.
All return under warranty shall be accompanied by the Certificate of Guarantee or a copy of the purchase invoice.
7.2 In general, the warranty covers manufacturing defects arising from normal use of the product. This excludes therefore:
- The replacement of consumables (batteries, straps ...),
- Damage resulting from abnormal or non-conform use of the products. We invite you to consult carefully the operating instructions supplied with the product
- Damage caused by the intervention of an unauthorized repairer,
- Damage resulting from an external cause to the product (accident, shock, etc.).
7.3 It should be noted that the duration of the manufacturer's warranty may vary depending on the model. The scope of the warranty for a product is detailed in the warranty certificate accompanying each watch.
Article 8 : Liability
8.1 The products proposed are in conformity with the Swiss legislation in force. LCWC cannot be held liable for non-compliance with the legislation of the country where the products are delivered. It is the Customer's responsibility to check with the local authorities the possibilities of importing or using the products or services that the Customer intends to order.
8.2 Photos are provided for illustration purposes only. LCWC therefore invites the Customer to refer to the description of each product to know the precise characteristics. In case of a manifest error between the characteristics of the product and its representation LCWC cannot be held responsible.
8.3 In the event of hypertext links pointing to other sites from the LCWC site, LCWC will not be responsible for the content of the information provided on these sites after activation of these links.
Article 9 : Applicable law - Disputes
9.1 This contract is subject to Swiss law. In case of dispute, the Swiss courts will have jurisdiction.
9.2 This contract is written in English.
9.3 The French version of this contract shall prevail over all translated versions.
Article 10 : Comment, Review, Communication
10.1 All reviews filed by the Client are monitored and moderated by the LCWC team. If the review breaks the law and ethics (misleading advertising, defamatory comments, insults, comments outside the context ...) LCWC reserves the right to refuse or modify the reviews concerned.
Article 11 : Ordering a product for use outside Switzerland
11.1 The Customer must take into account the fact that, in the context of the relocation of an order or product to a country other than Switzerland, he remains the importer of the products concerned. Customs taxes, local taxes, import taxes, or State taxes that may be required are under his responsibility. The Client must inform the local authorities of his country about the conditions of entry of the products ordered and must make any corresponding declaration and / or payment to the competent organizations of the country concerned.
Article 12 - The order has been settled with a Gift Card
Gift Cards cannot be exchanged, credited to a credit card or bank account, or discounted. They are not convertible into money and in no case may give rise to the refund of a difference in value between the price of the products or services purchased and the amount shown on the Gift Cards.
Article 13 - Assistance and representation
If you have any questions regarding the Site, the products sold by LCWC or complaint relating to an order, the Customer is invited to contact LCWC by e-mail at the following address: email@example.com , with his order number. LCWC will respond to the Customer within a reasonable period of time upon receipt of the request.
